Without a contract clause, two defaults stack: federally, the Interest Act §3 sets 5%/year as the implied rate; provincially, Code civil du Québec art. 1565 also sets 5%/year as the legal rate. Both are 5% by coincidence, not because they're the same rule. To charge anything other than 5%, your written contract must specify the rate (CCQ art. 1617).
